Cancellation policy

These are the terms for ColdCake campaigns. The Terms of service also apply.

1. Campaigns and prices

Delivery in Flanders and Brussels is included. A different size is possible, at an extra price per cake. We tell you that extra price before the bakery starts, and you only pay it if you agree to it first.

2. How it works

You start a campaign on coldcake.be, or by bank transfer through info@coldcake.be (article 3). By card, the first payment is taken straight away.
On the 1st of every month you receive the briefing form: who gets a cake and which message goes with it. Fill it in before the 10th.
The partner bakery bakes the cakes, ColdCake delivers them between the 15th and the 25th of the month.
After every delivery you receive a photo of the delivered cake.

3. Payment

If you pay by card, payment is taken automatically every month on the same day of the month as your first payment. Example: if you start on 12 June, the next payments follow on 12 July, 12 August, and so on.

If a payment fails, we retry the payment 3 more times, 2 days apart, and let you know. We deliver only once the payment has gone through.

Prefer a bank transfer? Email info@coldcake.be for an invoice. You receive it through Peppol, or by email if that is not possible. A campaign month only starts once your payment has arrived; only then does the bakery start. If your payment has arrived by the 10th of the month, we deliver that month; if it arrives later, we deliver in the next full month. Every following month you receive a new invoice in advance.

4. Changing, moving or pausing

Switching to another campaign takes effect from the next month. The current month stays as it is, without a pro rata refund.
You can move a delivery free of charge up to 48 hours before the planned delivery date. Later than 48 hours, you get 1 new cake free of charge on a new delivery date within 30 days, or you collect the cake by appointment, within the shelf life the bakery states. A cake in a campaign is not refunded separately, except in the cases of the Refund policy.
You can skip a month or pause the campaign, with no maximum. Let us know before the payment date of that month. You do not pay for a paused month.
To change, move or pause, write to info@coldcake.be or reply to an email from ColdCake.

5. Cancelling

Eerste Oven, Volle Bak and Hele Bakkerij can be cancelled monthly, with no minimum term and no notice period. For Op maat, the term and the cancellation are set out in the quote.
If you cancel before the next payment date, no new payment is taken.
If you cancel after a payment, that month is still carried out, without a refund.
You cancel by email to info@coldcake.be or by replying to an email from ColdCake.
ColdCake confirms your cancellation within 24 hours.

6. No briefing filled in

If your briefing is still missing on the 7th, you receive a reminder, and another one on the 11th.
If you do not fill it in that month, you still pay for that month, but the cakes move on to the next month. You can save up at most 1 month of cakes this way.
If you do not respond for 60 days, ColdCake cancels the campaign. Cakes for which no briefing arrived are then no longer delivered.

7. Quality and contact

For a complaint about a delivered cake, article 10 of the Terms of service and the Refund policy apply. With a campaign you also get a 30 minute call once per quarter about how the campaign is going.

8. Recipients

Allergens: the allergens of every cake are listed on the page behind the QR code on the cake and on coldcake.be/pages/allergenen. If you or a recipient want the full ingredient and allergen specification of a flavour, request it at info@coldcake.be; we send it. Do not send us data about anyone's allergy or health, see the Privacy policy, 3.3.
Delivery: ColdCake makes at most 2 delivery attempts. If we do not deliver, you do not pay. The only exception: you gave a wrong address, nobody is there after 2 delivery attempts, and you do not collect the cake within the shelf life the bakery states. This is article 3 of the Shipping policy.
Message: at most 60 characters per cake. What may not go on a cake is set out in article 13 of the Terms of service.

9. Liability

Article 11 of the Terms of service applies. For a campaign, ColdCake's liability is limited to the amount of 1 month of that campaign, except where the law prohibits such a limit.

10. Changes to these terms

If these terms change, every customer with a running campaign receives an email at least 30 days in advance. During those 30 days you can cancel free of charge if you do not agree.
