2. Scope

These terms apply to every order on coldcake.be, by businesses and by private individuals. By ordering you accept them. The customer's own terms only apply if ColdCake accepts them in writing.

3. Products

ColdCake delivers cakes with your design and a QR code in edible ink; behind the QR code, until 30 days after delivery, are your name and, if you give one, your message (Privacy policy, 3.2). There are 3 sizes (M, L and XL), 2 shapes (round or rectangular) and 2 flavours (vanilla and chocolate). The partner bakery bakes the cake, ColdCake delivers it itself. There are also campaigns with a fixed number of cakes per month (article 9), the design service, in which ColdCake creates the design for your cake, and the video service, in which ColdCake makes the video the recipient sees after scanning the QR code.

4. Prices

All prices on coldcake.be are in euro and include VAT: 6% on cakes and campaigns, 21% on the design service and the video service. Delivery in Flanders and Brussels is included. You pay the price shown on coldcake.be at the moment of your order. With the code EERSTECAKE20 you get 20% off your first order through the builder, on the cake, the design and the video by ColdCake. The code can be used once per customer, not on a campaign, and cannot be combined with another discount.

5. Ordering and payment

  • How to order: build your cake in the builder, then go through the cart to the checkout. In the cart you edit or remove your cake; at the checkout you check and correct your details. Your order is final once your payment succeeds; you then receive a confirmation email with a summary.
  • You can order in Dutch or English. ColdCake keeps your order for 10 years; you can request a copy at info@coldcake.be.
  • A single cake is paid once, when you order. A campaign is paid monthly in advance: by card, on the same day of the month as your first payment, or on request by bank transfer (article 3 of the campaign terms).
  • If a monthly card payment fails, we retry the payment 3 more times, 2 days apart, and let you know.

6. Invoices

If you order as a Belgian VAT-registered business, you receive a Peppol e-invoice, as the law has required between Belgian VAT-registered businesses since 1 January 2026. Give your company name and VAT number when you order, or email them to info@coldcake.be.

7. Delivery and cancelling

  • ColdCake delivers in Flanders and Brussels. Elsewhere in Belgium only on request, as set out in the Shipping policy. We do not deliver outside Belgium.
  • You choose the delivery date yourself, on a working day and at least 48 hours ahead; if you also order the design or the video by ColdCake, at least 3 working days ahead. We do not deliver on Mondays or on public holidays. ColdCake delivers the cake itself and sends you a photo after delivery.
  • You can cancel a single order free of charge up to 48 hours before the delivery date, with a full refund (Refund policy).

8. Right of withdrawal

A private individual who buys at a distance normally has a 14 day right of withdrawal. That right does not apply to ColdCake cakes: they are made to your specifications and they spoil quickly (article VI.53, 3° and 4° of the Belgian Code of Economic Law). It does apply to the design service and the video service. The conditions, the time limit, the procedure, the model form and where to find the withdrawal function are in the Refund policy. If you order as a business, the statutory right of withdrawal does not apply.

9. Campaigns

For the campaigns Eerste Oven, Volle Bak, Hele Bakkerij and Op maat, the campaign terms also apply. If the two texts contradict each other, the campaign terms prevail.

10. Complaint about a delivered cake

If the cake is damaged, spoiled or not printed as ordered, report it within 48 hours after the planned delivery date to info@coldcake.be, with a photo. If the complaint is justified, you choose between a new cake at no cost and a full refund. A taste preference is not a defect. The full rules are in the Refund policy. For private individuals, the statutory guarantee also continues to apply.

11. Liability

ColdCake's liability is limited to the amount of the order the complaint relates to. For a campaign, that is the amount of the month concerned. ColdCake is not liable for:

  • indirect damage, such as a missed deal or damage to reputation;
  • allergic reactions to allergens or possible traces listed on the page behind the QR code on the cake or on coldcake.be/pages/allergenen;
  • delays caused by third parties, such as the partner bakery;
  • force majeure.

These limitations do not apply insofar as the law prohibits them, for example for intent or gross fault, or for death or personal injury of a consumer caused by an act or omission of ColdCake (article VI.83, 13° and 25° of the Belgian Code of Economic Law).

12. Allergens

ColdCake contains gluten (wheat), eggs, milk and nuts (almond). Every cake is covered in marzipan, which contains almonds. The partner bakery also handles peanut, soy, celery, mustard, sesame, sulphite and lupin in the same room, so traces of these cannot be ruled out. The page behind the QR code on the cake and coldcake.be/pages/allergenen show all 14 allergens of Annex II to Regulation (EU) No 1169/2011. There is no separate allergen card with the cake. Anyone can request the full ingredient and allergen specification of a flavour at info@coldcake.be; we send it. ColdCake does not ask for or keep data about anyone's allergy or health (Privacy policy, 3.3).

13. Design, message and images

  • You confirm that you have the right to use the logo, the image and the message you supply.
  • ColdCake does not put a message or image that is offensive or infringes someone else's rights on a cake or on the page behind the QR code.
  • ColdCake only shows a photo or video of your cake, a delivery photo included, with your written yes, per cake, and your name and logo, also as a reference, only if you said yes to that (Privacy policy, 3.6). Without a yes we show nothing.

14. Personal data and cookies

How we handle personal data is set out in the Privacy policy. Cookies: chapter 5 of the Privacy policy and coldcake.be/pages/cookies.

15. Complaints and disputes

Send complaints to info@coldcake.be. Belgian law applies to these terms. For a dispute with a business, the court of Antwerp has jurisdiction; for a dispute with a private individual, the court designated by law. As a private individual you can also ask the Consumentenombudsdienst (Belgian Consumer Ombudsman Service) for free mediation.

16. Changes

ColdCake may change these terms. A change does not apply to orders already placed. Customers with a running campaign receive any change by email at least 30 days in advance.
